「通貨操作に関わる規則を提案しないこと、要求もしないこと」フローマン大使に宛てた通貨条項に関する書簡

現在米国議会・米国自動車業界において為替条項をＴＰＰに入れる声が声高に叫ばれ、フローマン代表も上院において「最後の段階で提案する」と表明しています。漏れ伝わる内容によれば、経常収支黒字国でかつ6ヶ月分の輸入代金を支払い可能な外貨準備高がある国を対象とし、協定前の輸入関税に戻すという罰則を含むようです。

この場合対象となるのはまず日本、続いてマレーシア、シンガポールとなります。
12月7～12日にワシントンで首席交渉官会合という名目のミニ交渉官会合が開かれ、場合によっては通貨条項も議論されるのではないかとのパブリック・シチズンの判断と依頼があり、篠原孝衆議院議員（前農水副大臣として）及び山田正彦前農水大臣の連名でＵＳＴＲフローマン氏に書簡を送りました。

これは、当初マレーシアと日本の閣僚経験者数名づつによる書簡として準備していたものですが、首席交渉官会合の日程がバタバタと決まり、また日本の衆院解散・総選挙が重なり、急遽日本からお二方の連名で出すこととなったものです。1月末の首席交渉官会合からも目が離せません。

フローマン大使殿

　私たちは、2013年6月6日付の下院435名中の230名、及び9月24日付の上院100名中の60名による超党派の議員による、通貨操作に対する規則をＴＰＰ協定に求める書簡を承知しています。また合衆国憲法が定める政治体制のそれぞれの機関の役割によれば、ＴＰＰが発効するためには連邦議会の承認が必要であることも承知しています。
　そうであれば、ＴＰＰ協定に通貨に関する規則が含まれない限り、議会の承認は得られず、発効も不可能であるということにもなります。その結果、仮に合衆国の交渉官がＴＰＰの条文としてそのような条項を提案する意図が無いとしても、最終的には議会において通貨操作に対する規則を協定に含めることが求められるため、合衆国の交渉官によって、ＴＰＰ交渉においてこのことが提案されることになるものと理解するものです。
　ＴＰＰ交渉参加国は現在、市場アクセスの条件について交渉をしており、通貨操作の規則が求められることを想定すべき段階にあります。従って、交渉参加国にとって、合衆国が果たして通貨条項について提案をするのか、またそれはいつになるのかを知ることが喫緊の課題となっています。
　大使閣下、是非合衆国の交渉官が通貨操作に関わる規則を提案しないこと、要求もしないことを確約していただくことは出来ないでしょうか？そのような確約をいただけないとしても、通貨操作に関する規則がいつかは提案されるものと想定せざるを得ず、いつ合衆国の交渉官が提案を明らかにするのか知ることが出来れば、とも考えるものです。通貨操作に関わる規則は、我々の国にとってのＴＰＰの功罪に深刻な影響を与えるものです。是非とも貴職から回答をいただきたい、きわめて重要な情報なのです。

Dear Ambassador Froman,

We are aware of the letter from 230 of the 435 US House Members dated 6 June 2013 and the 24 September 2013 letter from a bipartisan group of 60 of the 100 US Senators calling for disciplines on currency manipulation in the Trans-Pacific Partnership Agreement (TPPA).  And, we are aware that under the terms of the US Constitution setting forth the roles of each branch of government, the TPPA would have to be approved by the U.S. Congress for it to take effect.
Given this, it appears that the TPPA cannot pass the US Congress and thus cannot go into effect unless there are disciplines on currency manipulators included in the TPPA. As a result even if US negotiators have not yet proposed such terms for the TPPA text, we understand that ultimately inclusion of currency manipulation disciplines in the TPPA will be required by the US Congress and thus eventually will be proposed by US negotiators.
Since TPPA countries are now negotiating market access terms, a stage in negotiations that requires taking into account the prospective demand for such currency disciplines, it is critical that TPPA parties know if and when a U.S. currency proposal will be forthcoming.
Can you please assure us that US officials will not propose nor require terms disciplining currency manipulators within the TPPA context? If you cannot give us such an assurance, we must assume that such terms will be forthcoming and we would appreciate knowing when US officials intend to present their proposal. As this would significantly affect the costs and benefits of the TPPA for our countries, this is a crucial piece of information that we need from you.
