「民主主義の本質とは相容れない」400以上の市民団体が署名した米国連邦議会議員への書簡

米国Citizens Trade Campaign市民貿易キャンペーンから、「公正な社会と環境を実現する貿易政策のために」と題して、TPPやその他21世紀の貿易協定において、時代遅れの「ファストトラック権限」刷新と新たな方向性を要求して400以上の市民団体が署名し、米国連邦議会の議員に対して送った書簡を紹介します。TPPやEPAの本質を突いた具体的な提言が込められた書簡だと思います。

米国の貿易交渉官たちは、今後の基準ともなるアジア太平洋地域の新貿易・投資協定を10月までに締結することをめざしており、また、欧州連合との協定にも着手することを検討しています。そこで私たちは、21世紀における通商協定と過去の米国の貿易政策を、より公正で持続可能なグローバル経済を築く一助となる手段へ変貌させるために必要な議会の監視の役割について、我々の期待を共有するために合わせて1500万人以上に上る会員と支持者を代表し、ここに書き送ります。

環太平洋経済連携協定(TPP)は3月、シンガポールにて16回目の拡大交渉会合に入ります。しかし、米国の交渉官たちは、いまだにアメリカの一般市民に対し、米国の名のもとで提案している内容の発表を拒否しており、私たちは大いなる問題であると捉えています。また、提案事項を隠しているだけでなく、交渉が終了し協定が締結されるまで合意済みの文書をも公表しないことは民主主義の本質とは相容れません。この点に関し、TPPは過去のどの貿易協定よりも透明性に欠けていると言えます。例えば2001年、アメリカ合衆国は他の33カ国とともに米州自由貿易地域の原案を公表していますし、世界貿易機関内部の原案も頻繁に入手することが可能になっています。

TPP及び欧州連合と米国間の経済連携協定、その他の米国の貿易協定を、米国市民と世界中の人々の生活の質を実際に向上させる協定にするためには、少なくとも以下の課題に対処しなければなりません:

□人権と労働者の権利の優先。
既存の貿易政策のうち、あまりに多くの政策が投資家の権利保護に多大な労力を費やしています。一方、強制労働、児童労働、搾取的な労働環境、政治的暴力、環境悪化、先住民主権の侵害、そして言論の自由、集会の権利、移動の権利、独立した労働組合を設立する権利、団体交渉権といった基本的な権利に対する政府の弾圧を見て見ぬふりをするか、取り繕ってごまかしています。世界中の労働環境と環境活動における底辺への競争を反転させる助けとなるためには、人権と労働者の権利をいかなる貿易協定においても中心に据えるべきです。

□各地域の成長目標とその目標を果たす自治体による調達政策の尊重。
貿易協定は、参加国の政府が地域の成長や環境、社会一般のための目標に対して優先的に税金を投入することを妨げるべきではありません。貿易協定の調達規定は、既存の「バイ・アメリカン」米国製品購入の優遇を保持し、同様に現行賃金の要件、環境保護のための優遇、搾取を無くすための優遇、人権のための優遇、そして積年の不平等に対処する政策を維持するべきです。

□企業の立場を政府と対等の立場に引き上げないこと。
貿易協定は、個別の企業や投資家たちに対して、国内司法制度を迂回する法廷により、法律や規制、判決に異議を唱え、協定の条項を私的に執行するような特権を授与するものであってはなりません。ある国の法律により将来期待される利益が損なわれる、と訴える海外企業に対し、税金による無制限の補償を命じるような、3人の民間の弁護士からなる陪審団の存在を認める“投資家対国家”法廷制度は排除されるべきです。国際投資規則についても、各国政府が公共の利益のために規制する権能を保護するため、“投資”、“収用”、“待遇の最低基準”という用語等がより限定的に定義されるよう、見直されるべきです。

□食料主権の保護。
貿易協定は、農業従事者その他の食糧生産従事者が公正な報酬を得ることができ、消費者が安全で手頃な価格の食料の入手を確保できるような計画を実施する、という各国政府の権限を、尊重するべきです。同様に、国家は、農業従事者たちが廃業に追い込まれるような、不当な値下げやその他の不公正な貿易慣行から自国を守ることができるようにするべきです。

□手頃な薬価の医薬品を入手する権利。
手頃な価格のジェネリック薬剤の入手方法を維持することは、合衆国内での医療費削減のために、そして世界中の命を助けるために、決定的に重要です。医薬品の特許期間を延長するための手段として貿易協定を利用することは不適切であり、米国の政策は薬剤の入手に関するドーハ宣言に明記された基準を明確に支持するべきです。

□為替操作に対する予防措置。
貿易協定は、合衆国その他の政府が貿易を不当に歪める為替操作に対する対応策を含むべきです。更に貿易協定は、厳格な原産地規則の規定を備えることにより、貿易協定の恩恵がその規則の遵守に同意する国々に確実にもたらされるようにするべきです。

□厳格な金融規制と公共サービスの枠組み。
貿易協定は、銀行、保険会社、ヘッジファンド、その他の金融サービス提供者に対する規制に関して、上限ではなく下限を規定するものであるべきです。貿易協定のサービス規定には、いかなる民間もしくは公共サービスも規制緩和や民営化が要求されると解釈されない、明確且つ具体的な文言が含まれるべきです。

□より進んだ消費者・環境保護基準。
(上記と)同様に、貿易協定は、環境、食品・加工食品の安全性、消費者の知る権利の手段に関して、上限ではなく下限を規定するべきです。これらの高い基準を達成するには、市民および議会によるTPPその他の協定の監視がより一層必要であると考えます。オバマ政権に貿易政策決定に関する特別な権限を与える前に、TPPの原案を公表するよう求めてください。憲法に定められた「外国との通商を規制する」という議会専有の権限を、時代遅れで極端な手続きであるファストトラック「貿易促進権限」によって行政府に委譲するのではなく、下記の項目が満たされる新しい米国の貿易協定交渉と承認プロセスを支持するよう求めます:

□米国通商代表部が全ての利害関係者と協議し、貿易協定による影響を受ける事項を所管する全ての委員会とのヒアリングに参加し、想定されるそれぞれの貿易相手国がもたらすと考えられる具体的な雇用創出と輸出拡大の機会、そして提案される貿易協定がどのように関係国の人権、労働者の権利、環境、食料主権、薬剤の入手、為替操作そして貿易収支に影響を及ぼすかについての徹底的で公的な評価を提供することが必要です。
―この発展的な取り組みの一連の過程をできるだけ速やかにTPPに適用して、

□議会によって掲げられた交渉目標が、最終合意において実際に達成されていることを検証するための客観的な手順を確立し、

□行政府が協定に署名し、合衆国がそれらの条件に拘束される前に、提案されている貿易協定の内容が公益に沿い、議会の交渉目標が達成されていることを承認するためには議会の過半数が賛成しなければならない、という手続きを含むこと。

Only through this type of robust oversight and public participation can we forge a new national and global consensus on trade policy that works for all.
以上のような磐石な監視と市民参加を通してのみ、貿易政策について全ての人が納得する国民的かつグローバルな新しいコンセンサスを築くことができるのです。
